These Terms and Conditions (“Terms”) govern and form the entire basis of all contracts for the sale and supply of goods by CoirProducts.co.uk (the “Company”) to any purchaser (the “Customer”), whether acting as a consumer or in the course of business.
These Terms shall apply to the exclusion of any other terms, including any terms which the Customer seeks to impose or incorporate, or which are implied by law (to the fullest extent permitted), trade, custom, practice or course of dealing.
“Goods” means all gardening, horticultural and related products supplied.
“Customer” means any consumer or business purchaser.
“Contract” means any agreement incorporating these Terms.
Interpretation:
(a) References to statutes include amendments;
(b) Words include singular/plural;
(c) “Including” means without limitation;
(d) Headings do not affect interpretation.
2.1 Orders constitute an offer.
2.2 Acceptance occurs upon dispatch or written confirmation.
2.3 These Terms override all other terms.
2.4 No variation is binding unless agreed in writing.
2.5 The Customer confirms no reliance on external representations.
3.1 Goods are natural and horticultural products.

(b) plant growth;
(c) crop yield;
(d) disease resistance.

5.2 Improper storage voids liability.
5.3 Customer responsible for correct use and application.
6.1 Estimated delivery times for Mainland UK orders are typically between 2–10 working days unless otherwise stated.
6.2 All delivery timeframes provided by the Company are estimates only and are not guaranteed.
6.3 Time shall not be of the essence in relation to delivery.
6.4 Delivery times may vary due to factors outside the Company’s reasonable control, including but not limited to courier delays, adverse weather conditions, supply chain disruption, operational requirements, peak seasonal demand, or failed delivery attempts.
6.5 The Company shall not be liable for delays in delivery caused by third-party couriers or circumstances beyond its reasonable control.
6.6 Risk in the goods shall pass to the customer upon delivery.
Ownership transfers only upon full payment.
Company reserves right to recover unpaid goods.
8.1 Goods must be inspected within 48 hours.
8.2 Claims must be submitted within 5 working days.
8.3 Evidence (photos/videos) required.
8.4 Failure constitutes acceptance.
9.1 Consumers have statutory rights under UK law.
9.2 14-day cancellation rights apply.
9.3 Goods must be unused and in original packaging.
10.1 Returns must be authorised.
10.2 Customer responsible for return shipping unless faulty.
10.3 Refunds processed within 14 days of receipt.
10.4 Deductions may apply for used/damaged goods.

12.2 Restocking charges may apply.
12.3 No liability for commercial losses including crop failure.
13.1 Company may refuse claims where misuse or fraud suspected.
13.2 Evidence required for all claims.
13.3 Company may challenge chargebacks and recover costs.
14.1 Liability limited to value of Goods.
14.2 No liability for:
Customer indemnifies Company against claims arising from misuse, improper application, or resale.
No liability for events beyond reasonable control.

These Terms constitute the entire agreement and exclude reliance on external statements.
Invalid provisions do not affect remaining Terms.
England & Wales jurisdiction applies.
