These Terms and Conditions (“Terms”) govern and form the entire basis of all contracts for the sale and supply of goods by CoirProducts.co.uk (the “Company”) to any purchaser (the “Customer”), whether acting as a consumer or in the course of business.
These Terms shall apply to the exclusion of any other terms, including any terms which the Customer seeks to impose or incorporate, or which are implied by law (to the fullest extent permitted), trade, custom, practice or course of dealing.
1. DEFINITIONS AND INTERPRETATION
“Goods” means all gardening, horticultural and related products supplied.
“Customer” means any consumer or business purchaser.
“Contract” means any agreement incorporating these Terms.
Interpretation:
(a) References to statutes include amendments;
(b) Words include singular/plural;
(c) “Including” means without limitation;
(d) Headings do not affect interpretation.
2. BASIS OF CONTRACT
2.1 Orders constitute an offer.
2.2 Acceptance occurs upon dispatch or written confirmation.
2.3 These Terms override all other terms.
2.4 No variation is binding unless agreed in writing.
2.5 The Customer confirms no reliance on external representations.
3.PRODUCT INFORMATION AND NATURAL VARIATION
3.1 Goods are natural and horticultural products.
3.2 Variations may occur in:
- moisture content
- texture
- expansion volume
- nutrient levels
- colour and composition
3.3 Such variations shall not constitute defect or misdescription.
3.4 Images and descriptions are illustrative only.
4. HORTICULTURAL PERFORMANCE DISCLAIMER
4.1 The Company gives no guarantee of:
(a) seed germination;
(b) plant growth;
(c) crop yield;
(d) disease resistance.
4.2 Performance depends on:
- watering practices
- nutrient use
- climate conditions
- user handling
4.3 The Customer accepts all horticultural risk.
5. USE AND STORAGE
5.1 Goods must be stored correctly (dry, ventilated conditions).
5.2 Improper storage voids liability.
5.3 Customer responsible for correct use and application.
6. DELIVERY AND RISK
6.1 Delivery estimates are indicative.
6.2 Time is not of the essence.
6.3 Risk passes upon delivery.
6.4 Company not liable for courier delays.
7. TITLE
Ownership transfers only upon full payment.
Company reserves right to recover unpaid goods.
8. INSPECTION AND CLAIMS
8.1 Goods must be inspected within 48 hours.
8.2 Claims must be submitted within 5 working days.
8.3 Evidence (photos/videos) required.
8.4 Failure constitutes acceptance.
9.CONSUMER RIGHTS
9.1 Consumers have statutory rights under UK law.
9.2 14-day cancellation rights apply.
9.3 Goods must be unused and in original packaging.
10. RETURNS AND REFUNDS
10.1 Returns must be authorised.
10.2 Customer responsible for return shipping unless faulty.

10.4 Deductions may apply for used/damaged goods.
11. NON-RETURNABLE ITEMS
Includes:
- opened compost or coir
- hydrated bricks/discs
- perishable goods
- planted items
12. BUSINESS CUSTOMERS
12.1 Returns discretionary unless defective.
12.2 Restocking charges may apply.
12.3 No liability for commercial losses including crop failure.
13. FRAUD AND CHARGEBACK PROTECTION
13.1 Company may refuse claims where misuse or fraud suspected.
13.2 Evidence required for all claims.
13.3 Company may challenge chargebacks and recover costs.
14. LIMITATION OF LIABILITY
14.1 Liability limited to value of Goods.
14.2 No liability for:
- plant failure
- crop loss
- business interruption
- indirect loss
14.3 Nothing excludes liability for death/personal injury caused by negligence.
15. INDEMNITY
Customer indemnifies Company against claims arising from misuse, improper application, or resale.
16. FORCE MAJEURE
No liability for events beyond reasonable control.
17. DATA PROTECTION
Processed in accordance with UK GDPR.
18. ENTIRE AGREEMENT
These Terms constitute the entire agreement and exclude reliance on external statements.
19. SEVERABILITY
Invalid provisions do not affect remaining Terms.
20. GOVERNING LAW
England & Wales jurisdiction applies.
